1. What MealShift Is

MealShift ("the Service") is a free wellness tool that scores restaurant menu items based on factors like protein density, stomach-friendliness, portion size, glycemic impact, and fiber content. The Service is designed to provide general wellness information to help you make more informed choices when eating out.

MealShift is operated by MealShift ("we," "us," or "our"). By accessing or using the Service, you agree to these Terms of Service ("Terms"). If you do not agree, please do not use the Service.

2. Not Medical Advice

The scores, recommendations, and information provided through MealShift are for general informational and wellness purposes only. They are not a substitute for professional medical advice, diagnosis, or treatment.

• No doctor-patient, provider-patient, or any healthcare professional relationship is created by your use of MealShift.
• We are not healthcare providers, dietitians, or nutritionists.
• You should always consult with a qualified healthcare professional before making dietary changes, especially if you have any medical conditions or take any medications.
• Never disregard professional medical advice or delay seeking it because of information you found on MealShift.

3. Nutritional Information Accuracy

The nutritional data, scores, and assessments provided by MealShift are estimates, not guarantees. You should be aware that:

• Restaurant menu items, recipes, and preparation methods change frequently. Our data may not always reflect the latest changes.
• Actual nutritional content can vary based on portion sizes, preparation methods, regional variations, and individual restaurant locations.
• Our scoring system is based on general wellness criteria and may not account for your specific health needs, conditions, allergies, or dietary restrictions.
• We make reasonable efforts to provide accurate information but cannot guarantee the completeness or correctness of any data.

4. Your Responsibilities

By using MealShift, you acknowledge and agree that:

• You are responsible for consulting your healthcare provider about your dietary needs.
• Allergies and food sensitivities are entirely your responsibility. MealShift does not comprehensively track or warn about allergens. If you have food allergies, always verify ingredients directly with the restaurant.
• You will not rely solely on MealShift for dietary decisions, especially those related to a medical condition.
• You are at least 18 years of age.
• You will use the Service in compliance with all applicable laws and regulations.

5. User Accounts and Data

If you sign up for early access or create an account, you agree to provide accurate information. You are responsible for maintaining the security of any account credentials. We reserve the right to suspend or terminate accounts that violate these Terms.

6. Intellectual Property

All content, design, branding, scoring algorithms, and other materials on MealShift are owned by us or our licensors and are protected by copyright, trademark, and other intellectual property laws. You may not:

• Copy, modify, distribute, or create derivative works from our content without written permission.
• Scrape, crawl, or use automated tools to extract data from the Service.
• Use the MealShift name, logo, or branding without our prior written consent.

7. Limitation of Liability

To the fullest extent permitted by law:

• MealShift is provided "as is" and "as available" without warranties of any kind, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, and non-infringement.
• We do not warrant that the Service will be uninterrupted, error-free, or free of harmful components.
• In no event shall MealShift, its owners, employees, or affiliates be liable for any direct, indirect, incidental, special, consequential, or punitive damages arising from your use of (or inability to use) the Service, including but not limited to damages related to dietary decisions, health outcomes, or reliance on information provided by the Service.
• Our total liability to you for any claim arising from the Service shall not exceed the amount you paid us in the twelve months preceding the claim (which, since MealShift is free, is $0).

8. Indemnification

You agree to indemnify, defend, and hold harmless MealShift, its owners, employees, contractors, and affiliates from any claims, damages, losses, liabilities, costs, or expenses (including reasonable attorneys' fees) arising from:

• Your use of the Service.
• Your violation of these Terms.
• Your violation of any rights of a third party.
• Any dietary decisions you make based on information from the Service.

9. Modifications to These Terms

We may update these Terms from time to time. If we make material changes, we will notify you by updating the "Last updated" date at the top of this page and, where possible, by email. Your continued use of the Service after changes are posted constitutes your acceptance of the updated Terms.

10. Termination

We reserve the right to suspend or terminate your access to the Service at any time, for any reason, without notice. You may stop using the Service at any time. Sections that by their nature should survive termination (including Limitation of Liability, Indemnification, and Governing Law) will survive.

11. Governing Law

These Terms are governed by and construed in accordance with the laws of the State of Florida, United States, without regard to its conflict of law provisions. Any disputes arising under these Terms shall be resolved exclusively in the state or federal courts located in Florida.
